The following terms and conditions shall form part of your contractual obligations in applying to and being accepted for participation in the event.
1. GENERAL TERMS
The owners and organisers of Cannonball Run Europe are Cannonball Run Europe Ltd. Any reference to Cannonball Run Europe shall equally apply to Cannonball Run Europe Ltd.
You must hold a current valid driving license and a valid passport, and be over the age of 21 years.
2. THE EVENT
Entry into Cannonball Run Europe will be granted to those participants who have completed an entry form, paid the appropriate entry fee and have received confirmation of entry and receipt of payment from Cannonball Run Europe. The entry fee does not include personal acquisitions, petrol, telephone bills or other expenses and disbursements incurred while staying in the hotel (including courier/postal charges relating to sending left luggage to you), fines of any sort, or damage caused at any venue visited, which you will be responsible for paying to Cannonball Run Europe in addition to the entry fee within 30 days of receipt of an invoice from Cannonball Run Europe. The Event Director’s decision is final in any dispute or discussion.
3. PAYMENT / CANCELLATION
Cannonball Run Europe reserves the right to cancel or postpone the event or any part thereof should circumstances arise which make such action desirable or necessary. If it proves necessary for us to cancel the event, a full and immediate refund will be issued or where possible an alternative date offered. In the event of a natural disaster, flood, fire, strike, other act of God, outbreak of civil war or circumstances out of our control, the company will not be responsible for the refund of the entry fee.
A. After the commencement of the event Cannonball Run Europe will not make any refund of the entry fee or pay compensation to you if you are unable to continue in the event for any reason whatsoever.
B. Cannonball Run Europe Ltd reserves the right to refuse participation in or to cancel the event at any time for any reason whatsoever (without being obliged to disclose the reason). In case of refusal to allow you to participate, no refunds of the entry fee will be made. The route of the event is very demanding. If you are not able to complete any part of the route and are unable to stay at the provided venues you will not be entitled to any refund of the entry fee.
C. Upon entering the event, The venues are hired and dropping out does not entitle you to any compensation or refund of deposit paid regardless of circumstance.
You must not compete with other drivers in any manner. In particular, you must not race with other drivers. You must not place any bets of any kind in relation to the event. You must drive safely and with proper courtesy to all other participants and members of the public.
You must comply with all applicable laws and regulations whilst in the countries visited. Including without limit, appropriate laws of the road, the laws relating to the road worthiness of your vehicle and the laws relating to the possession, or importation of prohibited substances, illegal immigrants, goods or offensive weapons of any kind. If you are refused passage and/or entry/exit to or from any country visited en route, any additional cost incurred is your own responsibility.
Please note that ANYONE caught racing on the public highway in any country on route, will be excluded from further participation in the event immediately. No refunds will be made, and all privileges will be withdrawn (i.e. hotel reservations and entry to private parties).
You must conduct yourself appropriately at all times bearing in mind the rules of the hotels and other venues used during the event.
You must not drive at any time whilst under the influence of alcohol or any other intoxicating substances. You must not consume any other or illegal intoxicating substance at any time.
You will be refused further participation in the event if you violate any of the above rules or refuse to follow the instructions given to you during the event by the organisers. In such cases no refund will be given.
5. INSURANCE / LIABILITY
A. Participants are responsible for ensuring that vehicles used in the event are properly licensed and insured for use on public highways in Western Europe.
B. Participants are responsible for ensuring that they have Comprehensive insurance cover for the whole event.
C. Travel insurance is not included in the entry fee.
D. Cannonball Run Europe declines liability in any accident caused by or to participants and their vehicles during the whole of the event. Cannonball Run Europe also declines any liability for any breach of the laws and regulations of any country detailed in the itinerary. Participants shall be held responsible for any accident or breach of the laws in which they may be involved and shall declare to Cannonball Run Europe particulars of any such incident from which liability may arise and shall have no claim against Cannonball Run Europe arising out of any act or omission of Cannonball Run Europe, their servants, agents or officials during the course of the event.
E. Cannonball Run Europe accepts no responsibility or liability for the consequences of you being refused passage and/or entry/exit to or from any State/Country visited en route.
F. Cannonball Run Europe is covered by £5,000,000 Public Liability Insurance.
6. MEDICAL RESTRICTIONS
You will be driving in varied conditions and in changing climates, often for (very) long periods. If you have any medical conditions, which could be adversely affected by strenuous exercise or are in any doubts about your health, or taking any medication, you must get clearance from your doctors before returning the application form. Although you may be fit to take part, there may be relevant medical information about which we should know e.g. allergic reactions, diabetes, epilepsy etc. It is important that we know about any potential problems.
Hotels, where included as part of the entry fee, are offered subject to availability. Cannonball Run Europe reserves the right to alter hotel accommodation to that of an equivalent grade where necessary.
8. FORCE MAJEURE
A. Cannonball Run Europe, its directors and employees are not responsible if they cannot fulfil their obligations (including without limit the holding of the Event or any part of it) in cases of fire, earthquake, cyclone, flood, aridity, strike, lightning, war in the country, terrorist activities and similar troubles, blockade, embargo, confiscation and expropriation, and in other cases defined as force Majeure by any applicable laws and regulations.
B. Cannonball Run Europe cannot be held responsible if it is not possible for it to fulfil any one of its obligations or if a delay occurs in fulfilling its obligations due to any reason or situation beyond its will power and control, including, but not limited to, incidents arising from the operations of law enforcement in any territory, the general instructions of any relevant official institution, provisions of law, regulation and statute, instructions given by authorised officials, extraordinary situations, and other force majeure events.
C. If Cannonball Run Europe Ltd acting reasonably decides to call off the Event either before the Event or during the Event due to an incident (such as for example, a death or serious injury in connection with the Event, or an event that otherwise naturally detracts from the Event), such event will be considered to be a force majeure event in accordance with this clause and Cannonball Run Europe will have no liability, in particular and without limitation, to refund the entry fee or any part of it to any participant.
8. TRAVEL DOCUMENTS
Participants are responsible for ensuring that all travel documents required e.g. passports and visas are valid and effective.
9. TERMS & CONDITIONS AND WAIVER
A. Cannonball Run Europe reserves the right to change these terms and conditions from time to time subject to notifying you of the changes. You shall be deemed to have accepted the amended terms and conditions by participating in the event.
B. By participation in this event, made under the arrangements of Cannonball Run Europe Ltd, I acknowledge the danger of any adventure travel activity, including but not limited to: dangers in general road driving, driving on private roads and race tracks, travelling along mountainous roads, high altitude, forces of nature, civil unrest, terrorism, travel across water by hovercraft, ferry or similar, accident or illness without means for rapid evacuation or medical facilities.
C. I understand that in the event of my suffering any personal injury or death (other than personal injury or death caused by negligence) or any damage being caused to any property of mine that I will not bring any action or other proceedings against Cannonball Run Europe its directors, agents, employees, licensees or assigns, the event sponsors, or any company or persons associated with the Cannonball Run Europe 2016 event.
D. I agree to comply with all of the events terms and conditions of entry. I acknowledge and understand that Cannonball Run Europe Ltd will use reasonable efforts to ensure that all other participants abide by these terms and conditions of entry, but cannot guarantee that the participants will abide by these terms and conditions.
E. I indemnify Cannonball Run Europe ltd, its directors, agents and employees from all claims, demands, or expenses as a result of my breaching these conditions, my negligence or otherwise arising out of my participation in the event.
F. I acknowledge that there exist inherent risks in participating in an event such as the Cannonball Run Europe. Cannonball Run Europe will use its reasonable endeavours to ensure that the other participants abide by these rules, but cannot guarantee that this will be don Except for death or personal injury caused by negligence, which is not excluded or limited by anything in these Terms and Conditions of Entry, Cannonball Run Europe Ltd, its officers and employees exclude all liability in relation to your participation in the event.
G. These rules and your participation in the event are governed by English law, and you submit to the jurisdiction of the English courts.
